Terms and Conditions — Haven Garden Furniture

These terms govern your use of havengardenfurniture.co.uk and any orders you place with Haven Garden Furniture. By using the site or placing an order, you agree to them. Please read them carefully — they include limitations on our liability and rules about how disputes are handled.

References to "we", "us", "our", and "Haven" in these terms refer to Haven Garden Furniture. References to "you" and "your" refer to the person using the site or placing an order.

2. These terms

By placing an order you confirm that:

- You're at least 18 years old
- You have legal capacity to enter into binding contracts
- The information you give us is accurate
- You're using the site for lawful purposes only

We reserve the right to update these terms. The "last updated" date above will change when we do, and the version that applies to your order is the version live when you placed it.

3. Placing an order

How orders work

When you place an order through the site:

1. You add items to your basket and proceed to checkout
2. You confirm your delivery address, contact details, and payment method
3. You receive an **order confirmation email** acknowledging we've received your order
4. We review the order and send a **dispatch confirmation email** when items leave our warehouse — this email is the point at which a binding contract is formed between us

We can decline an order before sending the dispatch confirmation. If we do, we'll refund you in full and explain why (e.g. an item is out of stock, a pricing error, or we can't verify your details).

Pricing errors

We try hard to make sure prices on the site are correct. If we spot a pricing mistake before dispatch — for instance an item priced at £100 that should be £1,000 — we'll contact you, give you the option to reorder at the correct price or cancel for a full refund, and not dispatch until we hear back.

Stock

All orders are subject to stock availability. We try to keep stock levels accurate but occasional discrepancies happen. If something you've ordered isn't available we'll contact you with the option to wait, switch to an alternative, or cancel for a full refund.

4. Pricing, payment, and finance

Prices

All prices on the site are in **GBP** and **include VAT** at the prevailing UK rate. Delivery charges are shown separately at checkout (free on orders over £500 to the UK mainland — see Delivery below).

Payment methods

We accept: Visa, Mastercard, Amex, Apple Pay, Google Pay, Shop Pay, Klarna, PayPal — list what you actually offer]**.

Payment is taken at checkout. Card payments are processed by Shopify Payments and under their own terms.

0% finance

Finance applications are assessed by the finance provider, not by us, and approval is at their discretion. Finance is not available to anyone under 18 or to applicants outside the UK mainland.

5. Delivery

Where we deliver

We deliver to the UK mainland by default. Northern Ireland, the Scottish Highlands and Islands, the Isle of Man, the Channel Islands, and the Isles of Scilly carry a delivery surcharge — shown at checkout.

We don't currently deliver outside the UK.

Delivery times

- **Standard items** ship within **2 working days** and arrive within **5 working days** of dispatch.
- **Larger items** (outdoor kitchens, modular sofas, dining sets over 6 seats) take **7–9 working days**.
- **Bespoke configurations** take **[TO CONFIRM — typical lead time, e.g. 4–6 weeks]**.

These are estimates, not guarantees. We'll always tell you a realistic delivery window when you order, and email tracking when items dispatch. Delays caused by couriers, weather, or supplier issues are outside our reasonable control.

Free delivery threshold

Free delivery applies to orders over **£500** to UK mainland addresses. Below that, a delivery charge applies based on item size and destination — calculated at checkout.

Risk and ownership

Risk in your order passes to you when items are delivered to your address. Ownership passes once we've received full payment.

If no one is at the address on the agreed delivery day, the courier will leave a card with re-delivery instructions. After three failed attempts, items return to us and we'll contact you to arrange redelivery (which may carry an additional charge) or refund.

6. Your right to cancel and return

30-day right to cancel (Consumer Contracts Regulations 2013)

If you're a consumer (i.e. buying for personal, not business, use), you have the right to cancel your order **within 30 days** of receiving it, for any reason. This is broader than the statutory 14-day minimum — we offer 30 days as part of our customer promise.

How to cancel

Email **hello@havengardenfurniture.co.uk** with your order number. We'll arrange free collection within 3 working days. You don't need to give a reason.

When the right doesn't apply

The 30-day right to cancel **does not apply to**:

  • **Bespoke configurations** of outdoor kitchens that have been made or assembled to your specification
    - **Custom upholstery fabric orders** that have been cut to your specification
    - Items that have been used outdoors and/or weathered to the point of obvious wear
  • Items that have been damaged by you
  • Items that have been opened and used

These exclusions don't affect your statutory rights if the item is faulty, mis-described, or not fit for purpose.

Refunds

Once we've received returned items in their original condition, we'll refund you within **5 working days** to the original payment method. We don't deduct collection costs.

If something arrives damaged or faulty

Photograph it before the delivery team leaves and call **[TO CONFIRM — phone]** — we'll arrange a replacement immediately. If you spot damage after they've left, email a photo within **48 hours** to hello@havengardenfurniture.co.uk and we'll resolve it.

Under the **Consumer Rights Act 2015** you're entitled to a repair, replacement, or refund for items that are faulty, not as described, or not of satisfactory quality. We'll always aim to put it right at no cost to you.

7. Warranty

Our warranty covers manufacturing defects only — not damage from misuse, accidents, or exposure beyond reasonable use:

- **10 years** on every aluminium frame
- **3 years** on cushion fabric and rope
- **Lifetime** on welds

The warranty starts the day your order is delivered. You don't need to register — your order number is your proof of warranty.

To make a warranty claim, email hello@havengardenfurniture.co.uk with photos and your order reference. We'll assess the claim and, if covered, repair or replace the affected item at no cost.

8. Use of the site

You agree to use the site only for lawful purposes and in a way that doesn't:

- Infringe anyone else's rights
- Restrict or inhibit anyone else's use of the site
- Attempt to gain unauthorised access to any part of the site, server, or connected database
- Introduce viruses, malware, or harmful code
- Scrape, harvest, or systematically extract data from the site

We reserve the right to suspend or block access to anyone who breaches these terms.

9. Intellectual property

All content on havengardenfurniture.co.uk — text, photography, logos, design, code — is owned by Haven Garden Furniture or licensed to us. You may view and download content for personal, non-commercial use only. You may not:

- Copy, reproduce, or republish content elsewhere without our written permission
- Use our brand, logos, or photography for any commercial purpose
- Reverse-engineer the site or its underlying code

The Haven name and logo are trademarks of Haven Garden Furniture **[TO CONFIRM — registered or unregistered]**.

10. Reviews and user-generated content

If you submit a review, photo, or other content, you grant us a non-exclusive, royalty-free, worldwide licence to use it on our site, in marketing materials, and on social media. You confirm that:

- The content is your own original work
- You have the right to post it
- It doesn't contain anything defamatory, obscene, or unlawful

We reserve the right to edit or remove submissions that breach these terms or that we judge inappropriate.

11. Liability

Nothing in these terms limits our liability for:

- Death or personal injury caused by our negligence
- Fraud or fraudulent misrepresentation
- Any other liability that cannot lawfully be excluded under UK law

Subject to that, our total liability for any order is **limited to the price you paid for that order**. We're not liable for indirect or consequential losses (e.g. loss of profit, loss of opportunity) or for losses that weren't reasonably foreseeable when you placed the order.

If you're a consumer, this clause doesn't affect your statutory rights under the Consumer Rights Act 2015.

12. Force majeure

We're not liable for delays or failures caused by events outside our reasonable control — including (but not limited to) extreme weather, fire, flood, strikes, supply chain disruption, pandemic, or government action. If a force majeure event prevents us fulfilling your order within a reasonable time, we'll contact you to arrange an extension or full refund.

13. Trade and business customers

If you're buying for business use ("trade customer"), some terms work differently — particularly around the right to cancel and statutory consumer protections, which only apply to consumers. **[TO CONFIRM — do you have a separate trade programme with separate terms? 14. Privacy and cookies

15. Governing law and disputes

We hope it doesn't come to this — most issues can be resolved by emailing us first.
